When God gave the covenant at Sinai, He called it everlasting (Psalm 105:8-10). Now, since God is everlasting (outside of time) then He would know whether or not something else is. And, He said the covenant was everlasting, so it is… whether or not that agrees with our theology.
Jeremiah 31:31 says He will make a new covenant. The word for new is chadashah, it is a verb (chadash) that means, “to renew,” and it is being used as an adjective to describe the covenant (hence the slight form change). Literally, it is “covenant renewed.” That word is also the root for new as in “new moon.” We know it isn’t a different moon each month, it is the SAME moon renewing its cycles but we call it new, and translate it as new, because it introduces a new month. The word month comes from moon… and the moon, biblically, ushers in the “new moonth.” 🙂 But, again, it is the SAME moon just renewing it’s cycle.
Now… if what I just said about chadashah and renew is correct, then Hebrews 8:8 HAS TO agree, and it DOES! The Greek word for ‘new’ there is kainos. That word means “new in regards to FRESHNESS” and there is another word, nehos, that means “new in regards to age.” So, a 1968 Mustang that you buy and restore and make look like new, is kainos. A 2020 Mustang is nehos. In Hebrew AND in Greek, “I will make a new covenant” is renewed. Again, whether or not that stands in harmony with our theology, the words mean what they mean and if we seek truth, then we have to just let them mean what they mean.
Lastly… what has passed away isn’t the law, or the everlasting covenant… it is the law written on STONE. God is taking that which was on stone and writing it directly on our hearts. Same law, same God, different location for the text. So the old (stone) passes away, and is replaced by a heart of flesh (writing law on heart). Hence…
Ezekiel 11:19 I will give them an undivided heart and put a new spirit in them; I will remove from them their heart of stone and give them a heart of flesh.
This is key…… God gave the law on stone and commanded it be kept on the heart by His people (Deuteronomy 6:6); Israel failed, and now He will be writing that law where His people couldn’t keep it on their own. Same words, same God, different location. The anomian church, the church that says the law of God has been done away with, is why this isn’t understood. We’re born into a bias that we don’t even know exists and thus, this just sails right over our heads when it should have been obvious.
